Online Media Group Acceptable Use
Policy
This Acceptable Use Policy specifies certain
actions prohibited by Online Media Group for users
of Online Media Group services. Online Media Group
reserves the right to modify this policy at any
time to stay in compliance with any laws,
regulations and security requirements. By using
Online Media Group's services, any customer,
employee or third party unconditionally accepts the
terms of this policy.
General
Online Media Group will not tolerate any adult
material or spamming and both infringements shall
result in immediate termination and removal of the
site without a refund. Online Media Group prides
itself as a responsible member of the Internet
community and is committed to protecting the data
of, and providing quality service to, all Online
Media Group customers all of the time.
Illegal Use
Services provided by Online Media Group may only be
used for lawful purposes. Transmission or
publication of any information, data or material in
violation of any U.S. Federal or state regulation
or law is prohibited. This includes, but is not
limited to, material protected by copyright, trade
secret or any other statute, threatening material
or obscene material.
System Usage
Customer shall ensure that its use of Online Media
Group's network services shall not disrupt Online
Media Group, its associated networks or equipment
forming part of the systems. In instances in which
an excessive amount of system resources are
utilized by a subscriber, Online Media Group
reserves the right to place CPU process limits on
the Customer's account to prevent disruption of
service to other customers.
Network Usage
Use of Online Media Group's network connection in a
manner that is disruptive, damaging, unlaw-ful,
offensive, or intrusive as determined by Online
Media Group shall be considered a breach of this
Policy and may result in cancellation of service.
The term "Unlimited Bandwidth" implies that the
data transfer is not charged on a metered basis so
long as it remains within reasonable expectations.
Online Media Group considers 10 Gigabytes a
reasonable expectation for its servers. Accounts
whose total bandwidth is in excess of this
expectation will be subject to a surcharge.
E-Mail Abuse
Sending unsolicited mail messages, including,
without limitation, commercial advertising and
informational announcements, is explicitly
prohibited. A user shall not use another site's
mail server to relay mail without the express
permission of the site owner. No message may be
mass distributed, "broadcast," or otherwise sent on
an intrusive basis to any Online Media Group user
or to any directly or indirectly attached network.
This prohibition extends to sending of unsolicited
mass mailings from another service which in any way
implicates the use of Online Media Group's service,
Online Media Group's equipment or any site hosted
on any Online Media Group network.
System and Network Security
If you have been granted password privileges,
sharing your password with an unauthorized user or
third party is strictly prohibited. Violations of
system or network security are prohibited, and may
result in criminal and civil liability. Online
Media Group will investigate incidents involving
such violations and may involve and cooperate with
law enforcement authorities if a criminal violation
is suspected. Examples of unlawful acts are system
or network security violations including, without
limitation, the following: Unauthorized access to
or use of data, systems or networks, including any
attempt to probe, damage, scan or test the
vulnerability of a system or network or to breach
security or authentication measures without express
authorization of the owner of the system or
network. Unauthorized monitoring of data or traffic
on any network or system without express
authorization of the owner of the system or
network. Interference with service to any user,
host or network including, without limita-tion,
mailbombing, flooding, deliberate attempts to
overload a system and broadcast attacks.
Unau-thorized access to any data, system, or
network from an unauthorized system or network for
any purpose which is not lawful or which is
intended to do harm. Forging of any TCP-IP packet
header or any part of the header information in an
email or a newsgroup posting. Electronic forging of
any kind to include but not limited to IP
addresses, domains, business names, etc.
Distributing information regarding the creation of
and sending Internet viruses, worms, Trojan horses,
pinging, flooding, mailbombing, or denial of
service attacks. Also, activities that disrupt the
use of or interfere with the ability of others to
effectively use the network or any connected
network, system, service, or equipment.
Domain Transfer
Transferring your domain to another provider does
not constitute canceling your Online Media Group
account. You must notify Online Media Group to
formally cancel your account to avoid further
charges.
Interaction with Online Media Group
Staff
Any threat, vulgar language or harassment directed
at any Online Media Group staff member through
phone or email may result in immediate termination
of an account. Any violation of this policy by any
employee, contractor or third party programmer of
Online Media Group should be reported immediately
to abuse@onlinemediagroup.com.
Contact
On occasion, Online Media Group may have a need to
communicate with its customers via e-mail regarding
issues related to billing, as well as changes,
additions and modifications to the network. It is
the responsibility of the customer to check e-mail
sent to the primary login e-mail address on the
account. Additionally, It is the responsibility of
the customer to contact Online Media Group of any
changes to their account, such as phone number,
address, etc. Customers may be required to provide
verification for security purposes authorizing them
to make any changes to that account.

Online Media Group Terms of Service
All services provided by Online Media Group are
subject to the following terms and conditions:
Acceptance
By using Online Media Group's services, any
customer, employee or third party unconditionally
accepts the terms of this policy.
Customer Technical Support vs.
Consulting
Technical support is considered any questions,
guidance, or advice necessary with regard to the
server's operating environment. It includes
troubleshooting and repairing problems with the
server. Third-party software support, programming
advice, and coding assistance are considered part
of our Consulting Services and would thus be
charged out at Online Media Group's normal hourly
rate.
Domain Name Registrations/Transfers
Online Media Group is happy to assist with domain
name registrations, modifications or transfers.
However, please note that modifications may require
the extra follow up of the customer involved.
Because Online Media Group does not serve as a
principle contact, the administrative and/or
technical contacts may have to contact their domain
registrar directly to move the domain. In certain
cases it may be necessary for Online Media Group to
modify your domain database record. In the event
such an action results in a temporary disruption in
service, you agree to indemnify and hold harmless
Online Media Group.
Legal Restrictions
Online Media Group's services may be used for
lawful purposes only. Submission, transmission, or
maintenance of any information or materials in
violation of any federal, state, or local
regulations is prohibited. This includes, but is
not limited to, material legally judged to be
threatening or obscene. Online Media Group reserves
the right to refuse service to the customer without
providing reason or cause.
Copyright
Customer retains the copyright to data, files and
graphics provided by the customer, and grants
Online Media Group the rights to publish and use
such material. The customer must obtain permission
and rights to use any information or files that are
copyright by a third party; the customer is further
responsible for granting Online Media Group
permission and rights for use of the same and
agrees to indemnify and hold harmless Online Media
Group from any and all claims resulting from the
customer's negligence or inability to obtain proper
copyright permissions. Custom programing including
Perl, CGI, and HTML files coded by Online Media
Group for use in the customer's Web site will
remain the property of Online Media Group. Custom
artwork and graphics designed by Online Media Group
for use in the customer's Web site will remain the
property of Online Media Group; at its discretion,
Online Media Group will grant the customer rights
to use such material in formats other than Web
presentations.
Indemnity
The customer agrees to indemnify and hold harmless
Online Media Group from any and all claims
resulting from the customer's use of Online Media
Group's services which cause damage to the customer
or a third party.
